PRO-IP Act Signed into Law

Intellectual property owners can rest a bit easier knowing that the President signed The Prioritizing Resources and Organization for Intellectual Property Act of 2008, or the PRO-IP Act. With Orphan Works legislation looming, PPA is pleased to see that a bill tightening intellectual property enforcement was swiftly signed into law. PPA has worked vigorously through its involvement in the Copyright Alliance for the bill's passage.

"PPA has been a strong supporter of the PRO-IP Act," stated PPA CEO David Trust. "The passage of this important bill is a victory for photographers and all copyright holders."
The bill passed by Congress in late-September devotes additional resources to the enforcement and prevention of counterfeiting and piracy. This includes the creation of an Intellectual Property Coordinator position in the White House and an interagency task force. The IP Coordinator and task force will develop and implement strategies to protect intellectual property right across all industries.

With respect to copyright infringement, the law expands civil penalties allowing the seizure of documents and records related to the act. Additionally, copyright registrants may benefit from a "harmless error" provision that will not change an image's registration status if application errors are found that would not otherwise invalidate it.   

Senator Patrick Leahy (D-VT), Chairman of the Senate Judiciary Committee, commented, "The intellectual property enforcement legislation that President Bush signed into law is among the most important bills I have championed. At a time of financial and economic turmoil, streamlining the government's efforts to protect one of our most important assets--intellectual property--makes good economic sense..."
